Default Refund / court case / can anyone advice me ? - 18-03-2011, 02:49 PM

I come here out of the desperation born from not knowing. I bought a computer over the internet a year ago and it was not fit for perches. So naturally I asked for my money back with in the seven day cool down period. I did this with the use of email. They how ever instructed me to do this with using old school mail. I honestly dont know why. But in order to do that it pushed me over the seven day period.

So now they dont want to give my money back because it does not fall with in the seven day period. There is still one hell of a lot to this story but this is the shortened version.

The court date has been set for the end of this month and no one I speak to wants to advice me. I think I have a strong case because I have email with a time and date of when I originally asked them for the refund. This also includes their response 3 minutes later. But I just dont know. Any random chance anyone on this forum might know something ?

I think you are in a good position because you made them aware of what you where going to do and got a response form them via email.
which as long as you then sent them a letter as they requested wether it was in or out of the 7 days should hopefully get you a good result.

Have you tried going to the Citizens Advice Bureau?

Thank you. That is what I am thinking as well.

Yes I did contact them from the very start of the story and over the 6 months that it continued. But when I ask them for advice about the court case itsself they tell me that they are not qualified to advice me. So I am left with simply not knowing.

NEVER BUY FROM MESH COMPUTERS !

Just a fair warning. But what I am hoping most of all is that a win for me might get that company to be investigated by trading standards. Even if I dont walk away with any money. So long as I know they will get shut down.

having worked for multiple IT companies/ resellers etc. I know that 90% of the time they would settle out of court as its a bloody expensive business even if you are in the right.

By settling out of court. Do you have any idea what would be the common ... settling ... err things .... As you can tell I am well versed in the use of law. Could I ask for what I feel I deserve considering they dragged me through shit for a year ?

well i already paid the court cost. It was something like 400 pounds in total. But the computer was a little over 3000 pounds. I am a 3d artist I needs me beef when it comes to me Pcing.

Doesn't sound like you've been too unreasonable. The cynic in me says the snail mail is designed to trap you outside of the time period, as it has, although 7 days sounds short.

Don't piss the court off with asking for more than the value of the goods, this isn't Boston Legal.

You're not going to shut them down so don't expect that, it requires a much larger issue than one complaint.

Always buy on a credit card (doesn't mean I agree with credit) for the extra layer of insurance, and it can give you a powerful ally who can withhold their money if it's not been sent yet if you phone them quickly enough. They can fire your shots for you.

Always seek trading standards advice first, least then you know exactly where you stand.

In general though, disproportionate aggro for a computer mate, it's not worth endless drama.

Cheers for the response. Well it is not just one complaint. This company have literally thousands of 1 star ratings with people who complain about many of the stunts they tried to pull off. They constantly prey on the idea that the average Joe knows nothing about Pcs. Like for example.

Mesh guy. "I have good news for you Underpatch. We have found to problem with your computer. It turns out that is was a bad sector on the hardive. So because it is a hardive issue we consider it a software problem. So we are not giving you a refund."

Me."So you are telling me the bad wire shielding in the front usb unit. The over heating GPU that is causing screen corruption .The constant blue screening that seems to disappear when I disable hyper threading in the bios. The screen issues I am having are ALL because of a bad sector. "

Bet he did not know he was talking to someone who have been building hes own computers ever since he was 12. I am 33 now.

Yes as for the credit card. I got myself one 2 weeks after the refund time period passed. I wish i knew before hand. But I am not going ot make that mistake again.

Well The agro is more because I was saving for this computer so I can start working freelance. Now with that money gone and no computer to make my living off I have lost literally 1000`s of pounds of in come wich I will not be getting back.

Ahh I see, well that puts a different spin on it. The only other scare tactic I have heard of is to issue a "winding up notice" which instigates insolvency proceedings and can lubricate payment to stop the proceedings. This is more a business to business dynamic but if they look like they might go down, get in there quick as all the creditors will be fucked.
